A Pour Over Will pertains to the portion of one’s estate not already in the trust will simply “pour over” into the trust at death. Unlike a Will, the provisions of a living trust are not guaranteed to be a part of the public record. In many counties in New York, if one has a Pour Over Will, the Court will require that the trust referred to in the Will be submitted to the Court. Privacy of the contents of a living trust that a Will pours over into is not certain. Your Will should appoint an executor.
